Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) form a binding agreement between you and Archie Design App LLC(“Archie Design App,” “we,” “us,” or “our”) and govern your use of our mobile applications, websites, and related services (collectively, the “Services”). By downloading, accessing, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, if higher) to use the Services. If you are using the Services on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

3. Your Account

Some features require an account. You are responsible for the activity that happens under your account and for keeping your login credentials secure. Notify us promptly at privacy@archie-design.app if you suspect unauthorized use. We are not liable for losses caused by unauthorized use of your account that results from your failure to keep your credentials secure.

4. License to Use the Services

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the Services for your own personal, non-commercial use. This license does not transfer any ownership rights to you.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms;
• Copy, modify, reverse engineer, decompile, or attempt to extract the source code of the Services, except to the extent this restriction is prohibited by applicable law;
• Interfere with, disrupt, or overload the Services or their infrastructure, including through automated scraping, bots, or excessive requests;
• Circumvent security, rate limits, authentication, or access controls, or access data not intended for you;
• Upload or transmit malware, or content that is illegal, infringing, harmful, or that violates the rights of others;
• Resell, sublicense, or commercially exploit the Services without our written permission.

6. Your Content

Some apps let you create or store content (“Your Content”). You retain all ownership rights in Your Content. You grant us a limited license to host, store, process, and display Your Content solely to operate and provide the Services back to you. You are responsible for Your Content and represent that you have the rights necessary to submit it and that it does not violate these Terms or any law.

7. Purchases & Subscriptions

• Billing. Paid features and subscriptions are sold as in-app purchases and billed through the Apple App Store or Google Play. Prices are shown before purchase and may vary by region and over time.
• Auto-renewal. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period. Manage or cancel subscriptions in your App Store or Google Play account settings.
• Refunds. Because payments are processed by the app stores, refunds are handled under Apple’s or Google’s policies. We do not separately process app store payments or issue independent refunds for them.
• Consumable credits. Where an app sells consumable items or credits, they have no cash value, are non-transferable, and are non-refundable except as required by law or the applicable app store policy.

8. Third-Party Services & Stores

The Services are distributed through, and may integrate with, third-party platforms including the Apple App Store and Google Play. Your use of those platforms is governed by their terms. Where required, Apple and Google are third-party beneficiaries of these Terms with the right to enforce them, and you acknowledge that the app store providers have no obligation to furnish support or maintenance for the Services.

9. Intellectual Property

The Services, including their software, design, text, graphics, logos, and trademarks, are owned by Archie Design App LLC or its licensors and are protected by intellectual property laws. Except for the limited license granted above, these Terms do not grant you any rights in the Services or our trademarks.

10. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any content is accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

11. Limitation of Liability

To the maximum extent permitted by law, Archie Design App LLC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us for the Services in the twelve months before the claim, or (b) USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Archie Design App LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

You may stop using the Services at any time and delete your account. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Services. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and governing law — will survive.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Wyoming will have exclusive jurisdiction over disputes arising from these Terms, except where applicable consumer-protection law in your country of residence grants you the right to bring proceedings locally.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Effective date” above and, where appropriate, provide additional notice within the Services. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
